Scope of Application

Article 1

  1. All accommodation contracts and related agreements concluded between Minshuku Tōnohama (hereinafter referred to as "Tōnohama") and guests shall be governed by these Terms and Conditions. Any matters not stipulated herein shall be governed by laws and regulations or generally established customs.
  2. Notwithstanding the provisions of the preceding paragraph, if Tōnohama agrees to a special agreement that does not violate laws, regulations, or customs, that special agreement shall take precedence.

Article 2: Application for Accommodation Contract

  1. Guests wishing to apply for an accommodation contract with Tōnohama shall provide the following information:
    1. Guest name
    2. Date(s) of stay (including estimated arrival time if checking in outside of reception hours)
    3. A reachable email address
    4. Other matters deemed necessary by Tōnohama
  2. If a guest requests to extend their stay beyond the accommodation date specified in item 2 of the preceding paragraph while staying at Tōnohama, Tōnohama shall treat such request as a new application for an accommodation contract at the time the request is made.

Article 3: Formation of Accommodation Contract, etc.

  1. An accommodation contract shall be deemed to be formed when Tōnohama accepts the application set forth in the preceding article. However, this shall not apply if Tōnohama proves that it did not accept the application.
  2. When an accommodation contract for one night or more is formed in accordance with the provisions of the preceding paragraph, the full basic accommodation fee for the number of nights stayed shall be paid by the time of check-in.

Article 4: Refusal of Accommodation Contract

Tōnohama may not accept an accommodation contract in the following cases:

  1. When the accommodation application does not conform to these Terms and Conditions.
  2. When Tōnohama is fully booked and has no rooms available.
  3. When the applicant for accommodation is deemed likely to engage in acts that violate laws, public order, or good morals concerning accommodation.
  4. When the applicant for accommodation is deemed to fall under any of the following:
    1. An organized crime group (hereinafter referred to as "gang") as specified in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991), a member of an organized crime group (hereinafter referred to as "gang member") as stipulated in Article 2, Item 6 of the same Act, a semi-gang member, or a person related to an organized crime group, or any other antisocial force.
    2. A corporation or other organization whose business activities are controlled by a gang or gang member.
    3. A corporation whose officers include a gang member.
  5. When the applicant for accommodation makes violent demands to Tōnohama or its employees, or demands burdens exceeding a reasonable scope.
  6. When the applicant for accommodation is clearly deemed to be infected with a Class I, II, or III infectious disease as specified by the Ministry of Health, Labour and Welfare Ordinance.
  7. When Tōnohama is unable to provide accommodation due to natural disasters, facility malfunctions, or other unavoidable circumstances.
  8. When the applicant for accommodation is intoxicated or otherwise likely to cause disturbance to other guests.
  9. When there are remarks or behavior that significantly disturb other guests.

Article 5: Guest's Right to Cancel Contract

  1. Guests may cancel their accommodation contract by notifying Tōnohama.
  2. If a guest cancels all or part of the accommodation contract due to reasons attributable to the guest, Tōnohama shall charge a penalty fee as stipulated in Annex 2.
  3. If a guest does not arrive by 7:00 PM JST on the day of arrival without prior contact (or two hours after the pre-notified estimated arrival time), Tōnohama may deem the accommodation contract to have been canceled by the guest and process it accordingly.

Article 6: Minshuku Tounohama's Right to Cancel Contract

Tōnohama may cancel an accommodation contract in the following cases:

  1. When the guest is deemed likely to engage in or has engaged in acts that violate laws, public order, or good morals concerning accommodation.
  2. When the guest is clearly deemed to be infected with a Class I, II, or III infectious disease as specified by the Ministry of Health, Labour and Welfare Ordinance.
  3. When Tōnohama is unable to provide accommodation due to force majeure, such as natural disasters.
  4. When the guest is deemed to fall under any of the following:
    1. An organized crime group, gang member, semi-gang member, person related to an organized crime group, or other antisocial force.
    2. A corporation or other organization whose business activities are controlled by an organized crime group or gang member.
    3. A corporation whose officers include a gang member.
  5. When the guest makes violent demands to Tōnohama or its employees, or demands burdens exceeding a reasonable scope.
  6. When the guest is likely to cause disturbance to other guests due to noise, intoxication, etc., or when the guest's behavior significantly disturbs other guests.
  7. When the guest commits acts that impede fire prevention, such as smoking in designated non-smoking areas or tampering with fire-fighting equipment.
  8. When the guest allows persons other than the accommodation contract holder to enter the guest room, whether temporarily or not.
  9. When the guest brings or attempts to bring any of the following items into Tōnohama:
    • Firearms
    • Swords or similar weapons
    • Items with extremely offensive odors
    • Excessively large quantities of items
    • Highly flammable or combustible materials (e.g., gunpowder, volatile oils)
    • Plants, animals, insects, or similar items
    • Other items whose possession is prohibited by law
  10. When the guest takes hotel fixtures or items outside the hotel or moves them to another location within the hotel.
  11. When the guest attempts to alter, modify, or change the building or facilities.
  12. When the guest distributes advertisements or goods, engages in religious activities (proselytizing, soliciting), or conducts business activities towards other guests, visitors, or employees within the hotel.
  13. When the guest commits acts that significantly disturb other guests.
  14. When the guest does not comply with other usage rules stipulated by Tōnohama.

Article 7: Accommodation Registration

  1. On the day of accommodation, guests shall register the following information at Tōnohama's reception:
    1. Guest's name, age, gender, address, and occupation
    2. For foreign nationals, nationality and passport number
    3. Other matters deemed necessary by Minshuku Tōnohama.
  2. If guests intend to pay the charges specified in Article 10 by means other than currency, such as accommodation vouchers or credit cards, they shall present them at the time of registration in the preceding paragraph.

Article 8: Guest Room Usage Hours

  1. Guests may use Tōnohama's guest rooms during the following hours. The same applies to consecutive stays.
    Check-in: 4:00 PM JST
    Check-out: 9:00 AM JST
    Room available hours: 4:00 PM JST to 9:00 AM JST the following day.
  2. Notwithstanding the provisions of the preceding paragraph, Tōnohama may allow the use of guest rooms outside the hours specified in the same paragraph. In such cases, an additional charge as listed in Article 10, Paragraph 4, will be applied.

Article 9: Compliance with Usage Rules

Guests shall comply with the usage rules stipulated by Tōnohama and posted within the premises.

Article 10: Payment of Charges

  1. The breakdown of accommodation charges and other fees to be paid by guests and their calculation methods shall be as stipulated in Annex 1.
  2. Payment of the lodging fees and other charges mentioned in the preceding paragraph shall in principle be made via credit card pre-payment at the time of reservation. However, if Minshuku Tōnohama explicitly approves otherwise, payment may also be made at the front desk upon the guest's arrival or upon Minshuku Tōnohama's request, using Japanese Yen banknotes and coins, or vouchers and other alternative methods recognized by Minshuku Tōnohama.
  3. Even if the guest voluntarily does not stay after Tōnohama has provided a guest room and made it available for use, or voluntarily discontinues the stay after using the guest room, the full accommodation fee for all days will be charged.
  4. If the guest does not return the key that allows entry and exit to Tōnohama after check-out, a half-day's accommodation fee will be charged after 4 hours from the check-out time, and a full day's accommodation fee will be charged if the key is not returned by 6:00 PM JST. Please note that this does not guarantee accommodation for the day of the violation.

Article 11: Minshuku Tōnohama's Responsibility

  1. Tōnohama shall compensate guests for damages incurred by the guests in the performance of accommodation contracts and related agreements, or due to non-performance thereof. However, this shall not apply if such damages are not attributable to reasons on the part of Tōnohama.

Article 12: Handling When Contracted Room Cannot Be Provided

If Tōnohama cannot provide the contracted guest room to the guest, it shall, with the guest's consent, arrange other accommodation facilities under conditions as similar as possible.

Article 13: Handling of Deposited Items, etc.

  1. If items, cash, or valuables brought into Tōnohama by guests and deposited at the front desk are lost or damaged, Tōnohama shall compensate for such damages if they are due to Tōnohama's intentional act or gross negligence. However, regarding cash and valuables, if Tōnohama requested a declaration of their type and value and the guest failed to do so, Tōnohama shall compensate for damages up to a maximum of JPY 10,000.
  2. Tōnohama shall not be liable for theft, loss, or damage to items, cash, valuables not deposited at the front desk, or personal belongings (including items left in unmanned luggage storage areas within Tōnohama) in guest rooms or within Tōnohama premises. However, this shall not apply if such damages are due to Tōnohama's intentional act or gross negligence. Even in such cases, if the guest did not declare the type and value in advance, Tōnohama shall compensate for damages up to a maximum of JPY 10,000.

Article 14: Storage of Guest's Luggage or Personal Effects

  1. If a guest's luggage arrives at Tōnohama prior to their stay, Tōnohama shall be responsible for storing it only if agreed upon before its arrival, and will hand it over to the guest upon check-in at the front desk.
  2. If a guest's luggage or personal effects are left behind at Tōnohama after check-out and their owner is identified, Tōnohama shall contact the owner and seek their instructions. However, if there are no instructions from the owner or the owner cannot be identified, the items will generally be stored for one month, including the discovery date.
  3. Tōnohama's responsibility for the storage of guest's luggage or personal effects in the preceding two paragraphs shall be in accordance with the provisions of Article 13, Paragraph 1 for cases in Paragraph 1, and in accordance with the provisions of Article 13, Paragraph 2 for cases in Paragraph 2.

Article 15: Guarantee of Guest's Luggage or Personal Effects

Tōnohama shall not compensate for damages incurred by guests due to their failure to follow instructions, guidance, notices, or evacuation guidance from hotel staff or in emergencies.

Article 16: Guest's Responsibility

If Tōnohama incurs damage due to the guest's intentional act or negligence, the guest shall compensate Tōnohama for such damage.

Article 17: Disclaimer

When using computer communication within Minshuku Tounohama, customers do so at their own responsibility. Tōnohama shall not be held responsible for any damages incurred by users if the service is interrupted due to system failure or other reasons during the use of computer communication. Furthermore, if Tōnohama or a third party incurs damage due to acts deemed inappropriate by Tōnohama in the use of computer communication, the user shall compensate for such damage.

Supplementary Provisions

These Accommodation Terms and Conditions shall apply from August 1, Reiwa 7 (2025) (hereinafter referred to as the "Effective Date"). However, for accommodation contracts already concluded before the Effective Date, the old accommodation terms and conditions and usage rules shall apply.
